Assault suspect skips arraignment.

WEBSTER - A man allegedly kidnapped his estranged girlfriend from a McDonald's bathroom; he'd beaten her the night before, a police report from Dudley District Court said.

Kevin Montalvo, 19, of 25 Lincoln St., Apt. 2, didn't appear yesterday for his arraignment. A judge issued a default warrant.

Mr. Montalvo had posted $500 bail on kidnapping and assault and battery charges and had been released by police.

About 7:30 p.m. Monday Mr. Montalvo sped his vehicle, with its lights off, onto East Main Street from McDonald's. Detective Gordon D. Wentworth Jr. slammed his brakes to avoid a collision, the report said.

When Mr. Montalvo stopped his car, a woman darted from the passenger seat and ran toward the detective, who ordered her to stop.

Mr. Montalvo also got out, walked toward the detective and was ordered to stop.

Mr. Montalvo later claimed the woman needed drug treatment and he had followed her to McDonald's to get her help. The two were in a dating relationship and had two children, who are in custody of the state Department of Children and Families, police said.

The woman told police she and Mr. Montalvo had a violent altercation the night before in Worcester. Mr. Montalvo backhanded her, giving her an extremely swollen lip, the report said.

She also had cuts and abrasions on her face and she appeared to be sore, as if in a fight. She had difficulty walking and appeared frail and afraid. She did not appear to be intoxicated, police said.
