Judge John S. McCann
John L. Ausiello, 52, of the Worcester County Jail and House of Correction, West Boylston, sentenced to five concurrent terms of 12 to 13 years in Walpole state prison after pleading guilty to two counts of armed robbery, breaking and entering in the nighttime with intent to commit a felony, and two counts of intimidation to steal from a depository. He was sentenced to a concurrent term of 90 days in the House of Correction after pleading guilty to resisting arrest. He was placed on three concurrent terms of 10 years probation, to begin upon his release, after pleading guilty to three counts of assault and battery with a dangerous weapon. As conditions of probation, he was ordered to stay away from the victims and the locations of incidents. Three counts of assault and battery and eight counts of being a habitual criminal were dismissed at the request of the commonwealth.
Wilken Herrera, also known as Jesus Pastor-Perez, 26, of Lawrence, sentenced to 3 to 4 years in Walpole state prison after pleading guilty to trafficking in cocaine. He was sentenced to a concurrent term of 10 days in the House of Correction after pleading guilty to possession of cocaine. He was placed on two concurrent terms of 3 years probation, to begin upon his release, after pleading guilty to intimidation of a witness and making a false application for a motor vehicle license. As conditions of probation, he was ordered to remain drug- and alcohol-free, to submit to random drug tests, and not to possess any weapons including knives. A charge of giving a false name or Social Security number to police was filed after a guilty plea. A charge of drug violation near a school or park was dismissed at the request of the commonwealth.
Jennie Santana, 28, of 83 Columbus St., Fitchburg, sentenced to 3 to 4 years in Framingham State Prison after pleading guilty to trafficking in cocaine. She was sentenced to a concurrent term of 10 days in the House of Correction after pleading guilty to possession of cocaine. A charge of drug violation near a school or park was dismissed at the request of the commonwealth.
