Judge John S. McCann

Benjamin Ouwinga, 21, of 3 Old Elmdale Road, Uxbridge, was sentenced to three concurrent terms of two and a half years in the House of Correction after pleading guilty to three counts of assault and battery with a dangerous weapon (shod foot, floor, table). He was placed on two concurrent terms of two years' probation, to begin upon his release, after pleading guilty to burglary, amended from armed burglary, and civil rights violation. As conditions of probation, he was ordered to undergo drug and alcohol evaluations with any related treatment and counseling as recommended by the Probation Department and to pay $3,000 restitution. Charges of home invasion and armed assault in a dwelling were dismissed.

Jose L. Torres, 32, of 70 Canterbury St., Worcester, was sentenced to two and a half years in the House of Correction, with eight months to be served, after pleading guilty to distribution of heroin. The charge was amended from distribution of heroin (subsequent offense). The balance of the sentence was suspended for 18 months with probation. As conditions of probation, he was ordered to undergo drug and alcohol evaluations with any related treatment and counseling as recommended by the Probation Department. A charge of drug violation near a school or park was dismissed.

Judge Dennis J. Curran

Kevin Curran, 18, of 30 Bates Road, Gardner, was sentenced to one year in the House of Correction, with six months to be served, after being found guilty by a jury of assault and battery. The sentence is to begin upon his release from any other sentences now being served. The charge was amended from assault and battery with a dangerous weapon (knife). The balance of the sentence was suspended for three years with probation. As conditions of probation, he was ordered to undergo a mental health evaluation with any related treatment and counseling as recommended by the Probation Department, to submit to random drug tests, to stay away from the victim and witnesses, and to attend AA or NA meetings three times a week. He was found not guilty by a jury on charges of armed assault with intent to murder (knife), threatening to commit a crime (to kill), and intimidation of a juror.

Judge Austin T. Philbin

William B. Devitt, 65, of Holliston, charged with driving under the influence of alcohol or .08 percent (third offense), amended from driving under the influence of alcohol or .08 percent (fourth offense), sentenced to two years in the House of Correction, with 15 months to be served, balance suspended for two years, ordered to remain drug- and alcohol-free, to submit to random drug tests, to attend 90 AA meetings in 90 days and three AA meetings per week thereafter while on probation; driving negligently, filed with a guilty finding; and state highway traffic violation, found responsible, filed.

Erik B. Binienda, 32, of 304 Lake Ave., Worcester, charged with criminal harassment and threatening to commit a crime (to murder), continued without a plea or finding and placed on pretrial probation for one year, ordered to have no contact with the victim or the victim's family; and intimidation of a witness, dismissed without prejudice.

Carmen M. Rosario, 57, of 19 Village Drive, Southbridge, charged with larceny over $250 and receiving stolen property over $250, placed on probation for 18 months, ordered to remain alcohol-free.

Donna M. Allen, 46, of 151 Eastern Ave., Worcester, charged with threatening to commit a crime (to do bodily harm), continued without a plea or finding and placed on pretrial probation for three months, ordered to stay out of trouble and away from the victim.

Joseph Simmons, 50, of 14 Home St., Worcester, charged with assault and battery, dismissed.

Ramon G. Perez, 43, of 113 Elm St., Worcester, charged with assault and battery, dismissed.

John O'Brien, 32, of 125 South St., Auburn, charged with assault and battery, assault, and threatening to commit a crime (to murder), sentenced to three concurrent terms of one year in the House of Correction, with five months to be served, balance suspended for 18 months, ordered to undergo a mental health evaluation with treatment and counseling as recommended by the Probation Department, to remain drug- and alcohol-free, to submit to random drug tests, to attend a batterer's program, to abide by all restraining orders, and not to abuse the victims, $350 batterer's fee, $50 victim witness fee.

Douglas P. Hutchins, 42, of Shelton, Conn., charged with disturbing the peace, fined $150, $50 victim witness fee; disorderly conduct, filed with a guilty finding; assault and two counts of threatening to commit a crime (assault and battery, breaking and entering), dismissed.
