Worcester Superior Court

Judge Christine M. Roach

Juan Hernandez, 20, of the Worcester County Jail and House of Correction, West Boylston, sentenced to two concurrent terms of 3 to 5 years in Walpole State Prison after pleading guilty to two counts of statutory rape of a child. He was placed on seven concurrent terms of 5 years' probation, to begin upon his release, after pleading guilty to three counts of indecent assault and battery on a child younger than 14, three counts of statutory rape of a child, and intimidation of a witness. As a condition of probation, he was ordered to register as a sex offender.

Judge James R. Lemire

Jorge Ramos, 37, of 181 Summer St., Fitchburg, sentenced to three concurrent terms of 3 to 5 years in Walpole State Prison after pleading guilty to trafficking in cocaine and two counts of distribution of cocaine. Two counts of drug violation near a school or park were dismissed.

Dean J. Berube, 23, of 158 Olean St., Worcester, charged with driving while under the influence of alcohol or .08 percent causing serious injury, found not guilty; driving negligently, placed on probation for one year, ordered to remain employed or in school and to attend a half day at the Brains at Risk program; failing to slow down, found responsible, filed; vehicle lights violation and unsafe driving, found not responsible.

Juan Rodriguez, 53, of 28 Piedmont St., Worcester, charged with assault and battery, continued without a finding for six months, ordered to remain alcohol free, to submit to random drug tests, and to attend an anger management program, $50 victim witness fee.

Esmeralda Flores, 24, of 69 North Brookfield Road, Spencer, charged with larceny of less than $250, amended from larceny of more than $250, placed on probation for one year; and trespassing, amended from breaking and entering in the daytime with intent to commit a felony, filed with a guilty finding.

John A. Foggs, 50, of Springfield, charged with failing to register as a sex offender, amended from failing to register as a sex offender (subsequent offense), placed on probation for one year, $50 victim witness fee.

Matthew R. Herron, 24, of 8 Bancroft St., Auburn, charged with assault with a dangerous weapon (motor vehicle) and driving while under the influence of alcohol or .08 percent, found not guilty; driving negligently, continued without a finding for six months, ordered to remain drug and alcohol free, to submit to random drug tests, and to attend three AA meetings; and possession of an open container of alcohol in public, found responsible, fined $25.

Valerie N. Spencer, 26, of 6 Brenda Drive, Millbury, charged with malicious damage to a vehicle, found not guilty.

Judge Andrew M. D'Angelo

Jennifer A. Pelletier, 28, of 113 Main St., Oxford, charged with two counts of larceny of more than $250, two counts of identity fraud, and two counts of uttering a false check, continued to Dec. 18.

Edward R. Caldwell Jr., 37, of 325 Greenwood St., Worcester, charged with two counts of driving with a suspended license (subsequent offense), driving an uninsured vehicle, and driving an unregistered vehicle, sentenced to four concurrent terms of 90 days in the House of Correction, suspended for 90 days; vehicle equipment violation and license plate violation to conceal identity, dismissed.

Edeit H. Montalvo, 41, of 16 Maple Tree Lane, Worcester, charged with failing to register as a sex offender, placed on probation for one year, ordered to abide by sex offender regulations, $50 victim witness fee.
