Judge James R. Lemire

John Drollette, 46, of 23 Clifton St., Fitchburg, was sentenced to 2-1/2 years in the House of Correction, with 18 months to be served, after pleading guilty to possession of a loaded firearm while not at home or work. The charge was amended from carrying a firearm without a license. The balance of the sentence was suspended for 3 years with probation. He was placed on three concurrent terms of 3 years' probation, to begin upon his release, after pleading guilty to discharging a firearm within 500 feet of a building, malicious destruction of property over $250, and possession of a firearm without a firearm ID card. As conditions of probation, he was ordered to have no contact with the Hot Shotz Bar and victims, to undergo drug and alcohol evaluations with any related treatment and counseling as recommended by the Probation Department, to pay $600 restitution, and to pay $65 monthly probation fee while paying restitution. Charges of assault with a dangerous weapon (gun), threatening to commit a crime, and two counts of intimidation of a witness were dismissed.

Robert DiBenedetto, 24, of 23 Eagle Road, Worcester, was placed on probation for 3 years after pleading guilty to assault and battery. The charge was amended from assault and battery with a dangerous weapon (beer bottle). As conditions of probation, he was ordered to remain drug- and alcohol-free, to undergo drug and alcohol evaluations with any related treatment and counseling as recommended by the Probation Department, to submit to random drug tests, and to have no contact with the victim or the victim's address. A charge of mayhem was dismissed.

Judge Peter W. Agnes Jr.

Mitchell A. Archeval, 35, of 8 Hooper St., Worcester, was placed on probation for 5 years after pleading guilty to possession of cocaine with intent to distribute. The charge was amended from distribution of cocaine (subsequent offense). As conditions of probation, he was ordered to take all prescribed medications, to remain drug and alcohol free, to undergo a substance abuse evaluation with any related treatment and counseling as recommended by the Probation Department, and to submit to random drug tests. A charge of drug violation near a school or park was dismissed at the request of the commonwealth.
